Terms and Conditions




1. Definitions.

The WEBSITE - The website whose URL is www.torsionvideo.eu, www.torsionvideo.com or www.icarusdvd.com and all pages associated with it (but excluding URL links to unrelated companies) including, but not restricted to, all text, audio files and images (whether moving or static) contained within those pages.

The CONTENT - Any and all text, audio files, images, graphics, messages and communications, found in the WEBSITE. Such CONTENT includes graphical and textural depictions and descriptions of nudity and sexual conduct (variously of a heterosexual, bi-sexual, homosexual and/or transsexual nature).

YOU - A person desiring to access and make personal use of the materials appearing in the WEBSITE.

The COMPANY - Repute Ltd., the operator of the WEBSITE.


2. Binding Agreement.

This Agreement is made and entered into by and between YOU and the COMPANY.

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by YOU and the COMPANY, and by further accessing or otherwise taking advantage of the services and materials provided by the WEBSITE, YOU agree to be bound by all the terms and conditions set forth herein. Subject to the provisions set forth in these terms and conditions, the COMAPNY grants YOU a non-exclusive, but wholly revocable license, to access the WEBSITE.


3. Access Legislation.

Access to the CONTENT is authorized to YOU only if YOU are over the age of twenty-one (21) years and are accessing the WEBSITE in a jurisdiction where access to the CONTENT is legal for those over the age of twenty-one (21) years.

Additionally, access to the CONTENT is authorised to YOU only from locations where such content does not infringe upon or violate any local standard of decency, federal, state or local law or regulation, violate any civil or criminal law, or infringe any governmental regulation or court decision.

With regard to adult-oriented material and specifically the CONTENT, YOU are responsible for knowing and understanding all standards and laws in place for your location, jurisdiction and community. The COMPANY in no way represents or warrants that the CONTENT is compliant with your local legislation.


4. User Warrant.

YOU represent and warrant as follows:

"I freely and voluntarily choose to enter the WEBSITE because I want to view, read and/or hear the various materials that are available therein. I acknowledge that I wish to view, read and/or hear such CONTENT for my own personal enjoyment, information and/or education. My choice is a manifestation of my interest in sexual matters; an interest that I believe to be both healthy and normal. I am familiar with the standards in my community regarding the acceptance of such sexually oriented materials, and the materials I expect to encounter are within those standards. I will take reasonable and prudent measures to insulate the materials from minors and adults not willing to view such materials. I understand that it is my responsibility to secure the CONTENT from any person under the age of twenty-one (21) years and that I will not allow such persons to view the CONTENT either directly or indirectly. I have never informed any law enforcement agent or agency, any Postal Service or company, or any governmental agent or agency that I do not desire to obtain or receive sexually explicit materials. I will not bookmark the WEBSITE so as to bypass these terms and conditions."


4. Indemnification.

YOU agree to indemnify and hold harmless the COMPANY from and against any claims, losses, liabilities, actions, suits or other expenses (including all attorney's fees) arising out of a breach by YOU of any of your covenants, representations or warranties inferred by the COMPANY by your acceptance of these terms and conditions.


5. Legal Jurisdiction.

This Agreement shall be governed by and construed under the laws of England. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its termination. Any action arising under this Agreement shall be brought in the courts of England and YOU expressly agree to the jurisdiction and venue of such courts.
